In order to preserve his/her right to bring a claim in court for any of the above violations (Title VII, PDA, ADEA, ADA), an employee must first file a charge of discrimination with the Equal Employment Opportunity Commission (EEOC) within 300 days in Michigan or 180 days for states that do not have a state civil rights department. If an employee fails to file a charge within that time period, the employee loses the right to file a federal claim for those actions under the EEOC’s jurisdiction.
