Elder Law issues may include not only estate planning issues, but planning for long term care, preventing elder abuse, and preventing undue influence or depletion of assets. For example, concerns often arise when a parent or loved one must enter a long term care facility. This situation raises multiple issues, including the cost of care and applying for Medicaid coverage. However, it may also be necessary to petition the probate court to appoint a Guardian to make medical decisions for the individual, and a conservator to manage the individual’s assets.

Other concerns can arise when it is suspected that someone is taking advantage of an elderly individual and using their assets for an improper person. Unfortunately, there have been instances where compromised elderly individuals have given away large sums of money to individuals or charities. This again is an instance where it may be necessary to petition the probate court for the appointment of a guardian or conservator. These cases require proof that the individual is unable to manage their own affairs, including a medical opinion from a physician that the person is incapacitated.
